By accessing or using Talk to Gemma ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Talk to Gemma is an AI-powered English tutoring platform that provides:

  • Voice-based conversation practice with an AI tutor
  • Real-time pronunciation and grammar feedback
  • 10+ real-life conversation scenarios
  • Progress tracking and gamification features
  • Up to 3 hours of daily tutoring sessions

3. Account Registration

To use the Service, you must:

  • Create an account using Google authentication
  • Be at least 13 years of age
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

4. Subscription and Payment

4.1   Free Trial: New users receive a 3-day free trial. Your payment method will not be charged during the trial period.

4.2   Paid Subscription: After the trial, you will be charged $12/month unless you cancel. Payments are processed through Polar.sh.

4.3   Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

4.4   Refunds: We offer a 7-day satisfaction guarantee. Request a full refund within 7 days of your first paid charge if you're not satisfied.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Abuse, harass, or send inappropriate content to the AI
  • Attempt to reverse engineer or copy our AI technology
  • Share your account credentials with others
  • Use automated systems to access the Service
  • Interfere with or disrupt the Service

6. Intellectual Property

All content, features, and functionality of the Service are owned by Talk to Gemma and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. AI Limitations

While we strive for accuracy, Gemma is an AI and may occasionally provide incorrect information or feedback. The Service is designed as a supplementary learning tool and should not replace professional language instruction or certification preparation where human expertise is required.

8. Service Availability

We aim to provide uninterrupted service but cannot guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law, Talk to Gemma shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

10. Termination

We reserve the right to terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Talk to Gemma operates, without regard to its conflict of law provisions.
